TFS Hospitality Terms and Conditions

1. Orders & Payments
1.1. All orders are subject to acceptance by TFS Hospitality (“the Company”). No order will be processed or scheduled for production without valid proof of payment.
1.2. A 50% deposit is required to confirm all orders. The remaining balance must be settled in full before collection or delivery of goods.
1.3. Payments must be made via Electronic Funds Transfer (EFT) to the official TFS Hospitality bank account listed on our invoices. The Company will not accept responsibility for payments made to any other account.
1.4. Orders will only enter production once the deposit has cleared in our account.
1.5. All quotations are valid for 7 business days from the date of issue unless otherwise stated.
1.6. TFS Hospitality reserves the right to adjust prices in response to fluctuations in exchange rates, supplier pricing, or unforeseen material costs.

2. Lead Time & Urgency
2.1. We do not accommodate rushed, urgent, or same-day orders.
2.2. The standard production and supply lead time is 14 to 21 business days from the date the deposit clears, excluding weekends and public holidays.
2.3. Lead times may vary based on the complexity, quantity, or custom nature of the order.
2.4. Customers are advised to place orders well in advance to avoid delays.
2.5. TFS Hospitality is not responsible for delays arising from supplier shortages, load-shedding, strikes, or any other event beyond our control (force majeure).

3. Delivery & Collection
3.1. Orders may be collected in-store only once full payment has been received and cleared.
3.2. Delivery, if required, will be charged separately and must be confirmed in writing prior to dispatch.
3.3. TFS Hospitality may, at its discretion, arrange delivery through trusted third-party couriers; however, the Company will not be held liable for any loss, damage, or delay caused during transportation by external service providers.
3.4. Customers are responsible for ensuring accurate delivery information. Any re-delivery due to incorrect or incomplete addresses will incur additional charges.
3.5. Risk of loss or damage passes to the customer once goods have left our premises or have been collected by a courier on the customer’s behalf.
3.2. Delivery, if required, will be charged separately and must be confirmed in writing prior to dispatch.
3.3. TFS Hospitality may, at its discretion, arrange delivery through trusted third-party couriers; however, the Company will not be held liable for any loss, damage, or delay caused during transportation by external service providers.

3.5. Risk of loss or damage passes to the customer once goods have left our premises or have been collected by a courier on the customer’s behalf.
4. Returns & Exchanges
4.1. Returns will only be considered if:
• The product is defective, damaged, or incorrect upon receipt; and
• The issue is reported in writing within 7 days of delivery or collection.
4.2. Returned goods must be unused, unwashed, and in their original packaging.
4.3. Once inspected and approved, TFS Hospitality will, at its discretion, replace, repair, or refund the item.
4.4. Custom-made, branded, or special-order items are non-refundable and non-exchangeable.
4.5. The cost of return shipping (where applicable) is the responsibility of the customer unless the error is due to TFS Hospitality.

5. Cancellations
5.1. Orders may only be cancelled prior to production. Once production has commenced, cancellations will not be accepted.
5.2. In the event of a cancellation before production begins, a 15% handling fee may be deducted from the deposit to cover administrative costs.
5.3. Custom, bulk, or special orders cannot be cancelled once production has started.
5.4. If an order is cancelled after production has begun, the customer forfeits the deposit and remains liable for the full outstanding balance.

6. Liability & Warranty
6.1. TFS Hospitality’s liability is limited strictly to the replacement or refund of defective goods as outlined in the Returns Policy.
6.2. The Company is not responsible for indirect, incidental, or consequential losses resulting from delays, misuse, or third-party handling of products.
6.3. Product colours, textures, and finishes may vary slightly due to manufacturing processes or material availability. Such variations do not constitute defects.
6.4. The Company does not guarantee suitability for any specific purpose unless confirmed in writing prior to purchase.
6.2. The Company is not responsible for indirect, incidental, or consequential losses resulting from delays, misuse, or third-party handling of products.

7. Ownership & Risk
7.1. All goods remain the property of TFS Hospitality until full payment is received.

7.3. TFS Hospitality reserves the right to retain, withhold, or resell goods if payment is not completed as agreed.

8. Intellectual Property
8.1. All designs, images, product descriptions, branding, and written content remain the intellectual property of TFS Hospitality.

9. General Provisions
9.1. By placing an order, you acknowledge that you have read, understood, and agreed to these Terms & Conditions.
9.2. These Terms may be updated periodically without prior notice. The most recent version will apply to all transactions.
9.3. Any dispute arising from these Terms shall be governed by the laws of the Republic of South Africa.
9.4. TFS Hospitality reserves the right to decline or cancel any order that does not comply with these Terms or where fraudulent activity is suspected.
